Need for a local\u00a0agent\/distributor<\/strong><\/p>

Since foreign companies\u00a0cannot distribute at the retail level, a local agent or distributor can\u00a0be useful to build sales. The typical buyer will be a national
distributor or major retailer. However, it is possible to make sales
from off shore to a qualified importer for many products.<\/p>

Almost all consumer\u00a0food items are imported by companies with a general importers\u00a0license(IU=importer umum). Large entities, such as supermarket chains,\u00a0have their own importing and distribution affiliates, although they\u00a0also buy from independent importers. Hotels and upmarket independent\u00a0restaurants buy from many different importers as well as local\u00a0producers.<\/p>

Department of\u00a0Health Food Registration Procedures:<\/h2>
  • a registration
    application form<\/li>
  • a sample of food<\/li>
  • a label and brochure<\/li>
  • a letter of
    certification from the foreign factory (FDA or equivalent)<\/li>
  • a certificate of health<\/li><\/ul>

    Approval\u00a0Conditions of the Minister of Health<\/strong><\/p>

    • food meets the quality
      standards of the Minister<\/li>
    • is not prohibited in
      the country of origin<\/li>
    • is not harmful or will
      not negatively affect health<\/li>
    • is free of diseases
      contagious to people, plants, or animals<\/li><\/ul>

      Prohibitions<\/strong><\/p>

      • food cannot be putrid,
        repugnant, dirty, decayed or decomposed<\/li>
      • contains diseased
        vegetable or animal substances<\/li>
      • contains or has present
        more parts or excrement of insects than the maximum limit<\/li>
      • contains or has present
        more than the maximum limit of pesticides or other insecticides<\/li>
      • contains more poisonous
        chemicals, minerals, or metalloid, or additives than the maximum limit<\/li>
      • contains more
        pathogenic microorganisms than the maximum limit<\/li>
      • is unfit for human
        consumption or harmful to human health<\/li><\/ul>

        Approval<\/strong><\/p>

        • After the registration
          has been approved, the Ministry of Health will issue a registration
          number (preceded by letters ML) which must be clearly marked on the
          label of the food.<\/li><\/ul>

          LABELING AND\u00a0ADVERTISING REQUIREMENTS<\/h2>

          Labels must be in\u00a0the Indonesian or English language using Roman letters. <\/em><\/p>

          Labels must\u00a0contain the following information:<\/strong><\/p>

          • name of food and\/or\u00a0brand name<\/li>
          • ingredients, unless
            genially known to the public<\/li>
          • net contents or net\u00a0weight<\/li>
          • name and address of
            food producer, distributor or importer (including name of city and
            country or origin)<\/li>
          • registration number<\/li><\/ul>

            Additional\u00a0Labeling Requirements for Certain Foods<\/strong><\/p>

            • production code (lot\u00a0identifications)<\/li>
            • expiration date for\u00a0perishable foods as determined by the Ministry of Health<\/li>
            • storage instructions\u00a0(if required for certain foods such as milk products)<\/li>
            • usage instructions\u00a0(preparation and handling)<\/li>
            • nutritional value<\/li>
            • Specific wording or
              statements indicating contents for following products:
              • sweetened condensed
                milk (ed.go. \u201cWarning ! Not suitable for infants below six months old\u201d)<\/li>
              • food containing
                material of pig origin<\/li>
              • milk and food
                containing milk, baby food and commercially sterilized canned food
                (e.g. unsalted butter, contains no milk, reconstituted cheese, very low
                sodium, light syrup)<\/li>
              • artificial sweetener<\/li>
              • breast milk substitute<\/li>
              • food additives<\/li>
              • irradiated food<\/li>
              • \u2018Halal\u2019 food<\/li><\/ul><\/li><\/ul>

                \u00a0<\/strong>Foods\u00a0Requiring Expiration Dates<\/strong><\/p>

                  • Pasteurized milk<\/li>
                  • sterilized milk<\/li>
                  • fermented milk<\/li>
                  • dried milk\/milk powder<\/li>
                  • food and beverages
                    containing milk<\/li>
                  • baby food<\/li>
                  • commercial sterilized
                    canned food<\/li>
                  • bread, biscuits and
                    bread type products<\/li>
                  • low calorie food<\/li>
                  • nutrient supplement food<\/li>
                  • cocoa and cocoa products<\/li>
                  • nut and nut products<\/li>
                  • edible fat and oil<\/li>
                  • margarine<\/li>
                  • peanut butter<\/li>
                  • egg products<\/li>

                    Determination of\u00a0Date of Minimum Durability<\/strong><\/p>

                      • The producer shall\u00a0determine the date<\/li>
                      • In determining the date\u00a0marking, the producer shall take the following steps type of food,\u00a0method of processing, packaging, storage condition, availability of
                        storage at the distribution areas<\/li>
                      • The producer or the\u00a0importer must give the reasons or data to support the minimum
                        durability date.<\/li>
                      • The producer or\u00a0importer bears the responsibility for the date stated on labels.<\/li>
                      • Labeling Method<\/li>
                      • date must be stated in\u00a0Day\/Month\/Year format for food with a shelf life of up to 3 months, and\u00a0shall be declared in Month\/Year format with a shelf life of more than 3
                        months.<\/li>
                      • The date can be\u00a0indicated on the bottle top, bottom of a can, on the upper part of a
                        box and other suitable places, and must be clear and legible<\/li>
                      • The label must also\u00a0have a readily legible notice, as follows, \u201cUse best before \u2026(fill in\u00a0date)<\/li>
                      • The package or wrapping\u00a0of food containing material of pig origin must bear a notice in the\u00a0form of a picture of a pig and a writing which reads: \u201ccontains pork\u201d
                        and shall be written in red capital letters not smaller than Universal
                        12 point within a red box<\/li><\/ul><\/li><\/ul>

                        Food Additives\u00a0Permitted<\/h2>

                        antioxidant, anti caking\u00a0agent, acidity, regulator, artificial sweetener, flour treatment, agent\u00a0emulsifier, stabilizer, thickener preservative, firming agent, color,\u00a0flavor, flavor enhancer, sequestrant<\/p>

                        Each imported\u00a0additive must be accompanied by a Certificate of Analysis from the
                        producer in the country of origin<\/em><\/p>

                        Foods must arrive in
                        Indonesia (at the latest) according to the following time schedule:<\/em><\/p>

                          • 1.5 years before the
                            expiration date for food with a shelf life of 2 or more years<\/li>
                          • 8 months before the
                            expiration date for food with a shelf life of one year<\/li>
                          • 4 months before the
                            expiration date for food with a shelf life of 6 months<\/li>
                          • 2 months before the
                            expiration date for food with a shelf life of 3 months<\/li><\/ul><\/li><\/ul>
